CCMC TERMS AND CONDITIONS All Carolina Country Music Cruise passengers are required to acknowledge and accept the following CCMC Terms and Conditions Agreement (“TCA”):

  1. The TCA governs the relationship between all passengers and CCMC, LLC, its affiliates, employees, officers and directors (“CCMC”), , the TCA does not alter or amend the terms and conditions established between CCMC, Carnival Cruise Lines (“Carrier”) and passengers (https://www.carnival.com/popups/bookingengine/reservation-terms-and-conditions.aspx ) except for section 16 below.
  2. Any CCMC passenger ticket cannot be sold, resold, or used in conjunction with any promotional activity except as expressly authorized in writing by the CCMC. Any unauthorized use or purported transfer of the passenger ticket may result in denial of boarding and may subject the owner or passenger to legal action.
  3. EXCEPT TO THE EXTENT EXPRESSLY PROHIBITED BY APPLICABLE LAW, EACH OWNER OR PASSENGER ASSUMES THE RISK OF INJURY TO PERSON OR PROPERTY RESULTING FROM OR RELATING TO THE CAROLINA COUNTRY MUSIC CRUISE, HOWEVER CAUSED, WHETHER INTENTIONALLY OR UNINTENTIONALLY, OR WHETHER DUE TO THE ACT, OMISSION, OR NEGLIGENCE OF ANY OTHER PERSON, AND EACH OWNER OR PASSENGER FULLY, FOREVER, AND IRREVOCABLY RELEASES, ACQUITS, AND DISCHARGES CCMC AND EACH OF THEIR RESPECTIVE PARENTS, SUBSIDIARIES, AFFILIATES, DIRECTORS, OFFICERS, OWNERS, EMPLOYEES, SPONSORS, AGENTS, ATTORNEYS, SUCCESSORS, AND ASSIGNS FROM ANY AND ALL LIABILITIES, INJURIES, CLAIMS, DEMANDS, DAMAGES, LOSS, RIGHTS (WHETHER CONTINGENT, ACCRUED, INCHOATE, OR OTHERWISE), ACTIONS, OR CAUSES OF ACTION OF ANY NATURE, OR FROM WHATEVER SOURCE, ARISING OUT OF OR RELATING TO, IN WHOLE OR IN PART, OWNER OR PASSENGER’S PARTICIPATION IN THE Carolina Country Music Cruise AND ANY RELATED ACTIVITIES. CCMC HEREBY EXPRESSLY DISCLAIMS LIABILITY FOR ANY INJURIES, EMOTIONAL DISTRESS, MENTAL SUFFERING, PSYCHOLOGICAL INJURY, LOSSES, COSTS, EXPENSES, DAMAGES (CONSEQUENTIAL, INCIDENTAL, EXEMPLARY, PUNITIVE, OR OTHERWISE), CLAIMS, DEMANDS, AND ACTIONS OWNER OR PASSENGER NOW HAS, OR MAY HAVE, OR OWNER’S OR PASSENGER’S HEIRS, EXECUTORS, ADMINISTRATORS OR ASSIGNS MAY HAVE OR CLAIM TO HAVE, IN CONNECTION WITH OR RELATING TO THIS CRUISE.
  4. If the Carolina Country Music Cruise is cancelled due to an act of God, breakdown of the vessel, hostilities, medical outbreak, blockades, labor conflicts, strikes aboard or ashore, restraint of rulers or princes, war, fire, collision, directions of underwriters, arrest, order or restraint by governmental authorities or others, acts of terrorism, civil commotions, passenger safety, weather conditions and considerations of safety of the vessel (of which the Carrier shall be the sole judge), foundering of the vessel or breakdowns of or damage to its hull, machinery and fittings, inability to secure or failure of supplies, including fuel, requisition of the vessel or other circumstances beyond the CCMC’s control (including but not limited to a change in Carrier’s fleet deployment caused by any of the aforementioned events) (collectively, such causes shall be referred to as “Force Majeure Events”), the sole liability of CCMC to the owner or passenger shall be for a pro rata refund of any monies theretofore paid by owner or passenger to CCMC for the cruise hereunder for all obligations not then performed or for which the owner or passenger has not had benefit. Owner or passenger agrees that CCMC shall not be responsible for any incidental nor consequential damages incurred by owner or passenger.
  5. CCMC shall be entitled to the benefit of any applicable maritime laws and conventions providing for limitation and exoneration of liability, and nothing in this TCA is intended to operate to limit or deprive CCMC of any such limitation of liability or exoneration.
  6. CCMC is neither responsible nor liable for any loss of or damage to passenger’s property on the vessel or in connection with any air or ground transportation.
  7. CCMC makes no warranty, express or implied, as to the seaworthiness, fitness, or condition of the vessel or any food or drink supplied on board the vessel.
  8. CCMC assumes no liability whatsoever for any treatment, diagnosis, advice, examination or other services provided by any medical personnel or other service providers on board the vessel or at any ports of call.
  9. All arrangements made for or by owner or passenger for air transportation, shore excursions, tours, ground transportation, hotels, restaurants, and other similar activities or services are solely for owner or passenger’s convenience and are at owner or passenger’s risk, and CCMC assumes no liability therefor.
  10. CCMC shall not be liable if, at any time and without prior notice, the Carrier cancels, advances, postpones, or deviates from any scheduled sailing or port of call, or substitutes another vessel or port of call.
  11. CCMC SHALL HAVE THE UNFETTERED RIGHT TO USE ANY PASSENGER’S NAME, VOICE, ACTIONS, CONVERSATIONS, SOUNDS, LIKENESS, PHOTOGRAPH, OR IMAGE, AUDIO OR VIDEO RECORDINGS OF PASSENGER, OR ANY VISUAL PORTRAYALS OF PASSENGER IN ANY MEDIUM OR MEDIA OF ANY NATURE WHATSOEVER THROUGHOUT THE UNIVERSE INTO PERPETUITY FOR ANY PURPOSE, INCLUDING BUT NOT LIMITED TO TRADE, ADVERTISING, SALES, PUBLICITY OR OTHERWISE, WITHOUT COMPENSATION TO PASSENGER OR RIGHT OF REVIEW BY PASSENGER, AND ALL RIGHTS, TITLE, AND INTEREST THEREIN SHALL VEST IN CCMC (INCLUDING ALL WORLDWIDE COPYRIGHTS THEREIN), FREE FROM ANY CLAIMS FROM PASSENGER, INCLUDING BUT NOT LIMITED TO CLAIMS FOR FEES, ROYALTIES, PAYMENT, OR ANY OTHER CLAIM OR CAUSE OF ACTION AGAINST THE CCMC(INCLUDING, WITHOUT LIMITATION, ANY CLAIM THAT FOR INVASION OF PRIVACY, MISAPPROPRIATION OF THE RIGHT OF PUBLICITY, OR ANY CLAIMS BASED ON DEFAMATION, LIBEL, SLANDER OR FALSE LIGHT), AND ANY OTHER RELATED CLAIM OR CAUSE OF ACTION, EXCEPT TO THE EXTENT EXPRESSLY PROHIBITED BY APPLICABLE LAW.
  12. CCMC shall have no liability for any changes in itinerary, including but not limited to departure and return ports, ports of call, order of ports and berthing times, ship, scheduled entertainment (including artist performances), hotels, excursion packages, other add ons, and amenities.
  13. Any disputes and matters whatsoever arising under this TCA or relating to CCMC in connection with the Carolina Country Music Cruise or related activities must be filed in a court of competent jurisdiction located in Mecklenburg County, Charlotte, North Carolina; provided, however, that in the event of a dispute or matter governed (in whole or in part) by the Carnival Cruise ticket contract, the terms of the Carnival Cruise ticket contract (including but not limited to the choice of law and venue provisions) shall apply.
  14. CCMC has multiple payment plans available to passengers for the Cruise. By selecting one of the payment plans available, you authorize CCMC to charge your Payment Method pursuant to the terms of the option chosen, without additional notice to you. You expressly agree not to dispute any credit card charges associated with this trip. CCMC reserves the right to charge additional fees for returned payments, late payments, missed payments, canceled cards, chargebacks, credit card changes and invalid credit cards. The fee assessed shall be up to $150 per person plus 5% of the total transaction.
  15. All passengers must carry a certified copy of their birth certificate plus government issued photo ID, a valid passport or valid passport card which expires at least six (6) months after the return date of the cruise. It is the responsibility of the passenger to verify the documentation they will be presenting is valid and all said passenger needs to travel. Failure to comply with the Travel Documentation / Passport Policy will result in a cancellation of your booking at no refund to you.
  16. All payments to CCMC are non-refundable. This supersedes section 6 only of the Carnival Ticket Contract referenced herein. CCMC may adjust itineraries and schedules, change any talent performing onboard the cruise, delay departures or arrivals without any further obligation to you. CCMC reserves the right to refuse service to any person or cancel your reservation at any time at our sole discretion. CCMC will not be responsible for any losses including but not limited to lodging or airfare incurred due to a cancelled/delayed flight or other means of transportation. Passenger name changes will be assessed a $100 per change fee.
  17. The cabin prices advertised are “cruise only”. The price does not include airfare, ground transportation or onboard purchases. It does include meals (except for meals at the specialty restaurants), shows and onboard events produced by CCMF Cruise unless otherwise noted.
  18. Port Charges/Taxes/Gratuities/Admin Fee(s) are due at final payment and satisfy guests total obligation for port expenses, government taxes, fees, gratuities and the booking administration fee.
  19. All payments to CCMC are nonrefundable so we strongly encourage the purchase of Travel Protection. Please inquire at the time of booking about Travel Protection, as certain benefits are time sensitive. Travel Protection must be purchased within 14 days of deposit to cover any pre-existing conditions.
  20. Unless otherwise noted, all prices on the website and any fees associated with the Cruise including any applicable taxes are quoted in United States Dollars (“USD”). All payments to CCMC will be charged in USD to your selected payment method. You may incur an additional fee by your bank or credit card processor if it is an international transaction. CCMC is not responsible for such fees, if any.
